*** Telework (Within Minnesota or neighboring states) and flexible hours options are available.*** As a Rulemaking Attorney, you will provide legal expertise to the Department of Human Services (DHS). This position is part of the Administrative Law Office within the Department’s General Counsel’s Office. The individual in this position will conduct legal and policy research, perform analysis on diverse and complex matters, provide legal advice, and produce written products for a variety of audiences and purposes related to rulemaking, Commissioner Delegations of Authority, litigation monitoring, the Minnesota Olmstead Plan, data privacy, and general compliance duties. As the agency lead attorney in rulemaking, this position regularly provides legal support and advice across nearly all agency divisions of the Department and to Department leadership, Senior Management, the Administrative Law Office, and program staff on rulemaking and related topics. This position routinely advises on the development and implementation of Department legal policies and best practices that have far-reaching implications. This work often involves advising on legal issues that are complex, novel, and/or require understanding of how multiple areas of law and policy interact. Responsibilities include but may not be limited to: Staff Attorney 2 • Direct, coordinate and oversee agency-wide rule-related activities and obligations. • Serve as the expert project manager on rulemaking projects by advising and directing agency staff and management, including Senior Leadership, through the rules promulgation process. • Coordinate the ongoing evaluation of administrative rules governing programs administered by the Department. • Evaluate risk and determine areas of greatest need for rule revision. • With program staff, including leadership, evaluate and advise on alternatives rulemaking options. • Advise on litigation involving rulemaking. • Review and evaluate Commissioner Delegations of Authority as proposed by program areas across the Department and work to resolve legal issues.. • Provide legal counsel on diverse and complex legal and compliance issues to Department leaders and staff, and develop and maintain policies and procedures to support agency compliance and to minimize legal risk to the Department. • Responsible for acting as a legal advisor to the Commissioner on contested licensing and Surveillance and Integrity Review (SIRS) cases on a back-up basis. • Responsible for providing legal counsel to the Department regarding litigation related to persons with developmental and intellectual disabilities, data privacy, and the Department’s Olmstead Plan obligations. Staff Attorney 3 • Direct, coordinate and oversee agency-wide rule-related activities and obligations. • Serve as the expert project manager on rulemaking projects by advising and directing agency staff and management, including Executive Leadership, through the rules promulgation process. • Coordinate the ongoing evaluation of administrative rules governing programs administered by the Department. • Evaluate risk and determine areas of greatest need for rule revision. • With program staff, including leadership, evaluate and advise on alternative rulemaking options • Advise on litigation involving rulemaking.. • Review and evaluate Commissioner Delegations of Authority as proposed by program areas across the Department and work to resolve legal issues. • Train, advise and support the Department’s compliance with diverse, complex, and changing state and federal laws in the areas of rules, data privacy, data security, and related policies. • Responsible for acting as a senior legal advisor to the Commissioner on contested licensing and Surveillance and Integrity Review (SIRS) cases on a back-up basis. • Responsible for providing legal counsel to the Department regarding litigation related to persons with developmental and intellectual disabilities, data privacy, and the Department's Olmstead Plan obligations.

**To facilitate proper crediting, please ensure that your resume clearly describes your experience in the areas listed and indicates the beginning and ending month, day and year for each job held.** Staff Attorney 2 • Juris Doctorate (JD) degree from an ABA accredited law school. • Current license and in good standing to practice law in Minnesota. • At least three (3) years’ experience as a practicing attorney in Administrative Law or Civil Litigation. • Experience must demonstrate the following: o Strong legal research, analysis, and writing skills; o Building and maintaining good working relationships with internal and external stakeholders; o Providing legal advice to executive leadership on diverse and complex issues; and o Knowledge of both federal and state statutes, regulations and policies relating to the licensing of human service programs and rulemaking. Staff Attorney 3 • Juris Doctorate (JD) degree from an ABA accredited law school. • Current license and in good standing to practice law in Minnesota. • At least five (5) years’ experience as a practicing attorney in Administrative Law or Civil Litigation. • Experience must demonstrate the following: o Strong legal research, analysis, and writing skills; o Building and maintaining good working relationships with internal and external stakeholders; o Providing legal advice to executive leadership on diverse and complex issues; and o Knowledge of both federal and state statutes

• Knowledge of and experience handling issues related to state and federal privacy laws as they relate to human services programs. • Experience representing clients in civil litigation. • Experience working with the Attorney General’s Office and/or State government agencies. • Variety of experiences working effectively with others from different backgrounds and cultures.
